The information you access or receive through the website at https://www.totbot.io/ and any AI tools, programs, applications or services (collectively, the "Service") provided by the Company (or any of its subsidiaries) (collectively, "we", "us" or "our") is subject to these Terms and Conditions ("Terms", "Agreement").

The use of and access to the Service will constitute acceptance of these Terms. If you do not agree with any part of these Terms, you must discontinue using the Service immediately.

1. Definitions

For the purposes of these terms, the following terms are used:

  • The terms "user", "you", and "Your" mean you, the person or entity using or accessing the Service.
  • Any text, essays, documents, images, equations or files that you may upload, type, or submit to the service for processing are considered "User Content".
  • "Generated Content" means any words, images, or files produced by our AI tools in response to your input or instructions.

2. Acceptance of Terms and Eligibility

Accessing Totbot.io constitutes your agreement and representation that you are at least 18 years old or that you have legal authorization as a parent or guardian of anyone under 18 years old to use this service. You also agree that you are not prevented from getting services under the laws of the United States and/or other applicable jurisdictions.

We also encourage you to review our Privacy Policy, which explains how we collect, process, and protect your data when you use the Service. You consent to all of these Terms and agree to the practices outlined in the Privacy Policy by agreeing to these Terms.

3. Acceptable Use of the Service

Totbot.io offers numerous text, maths, and image AI solutions. You agree that you will use these tools for lawful and legitimate purposes and in compliance with these Terms.

You strictly agree NOT to:

  • Use the Service in any way that violates any applicable national or international law or regulation.
  • Try to break, bypass, or decompile algorithms and security from our AI tools.
  • Access or "scrape" the Service using any automated method, such as a bot, a web crawler, scripts or unauthorised APIs.
  • Upload viruses, malware, or damaging files or code that might affect Service operations or the users.
  • Create, promote or distribute harmful, illegal, defamatory, highly explicit or dangerous content using our generative AI tools (including the AI essay creator or AI sentence creator).
  • Violate other people's intellectual property by posting copyrighted content without permission.
  • We reserve the right to monitor usage of the Service and may suspend or terminate access for any user who violates these Acceptable Use guidelines.

4. User Content and Data Processing

We respect your files and photographs and never publish them without your authorisation.

Temporary Processing: User content (documents or images) uploaded to the app, when using the AI Summariser or Image-to-Text converter, is processed temporarily to create the output you requested.

No Document Storage: We never store, preserve, or index any documents you submit in our internal or external databases. Your uploaded content is used solely to generate your requested output and is not retained afterward.

Data Loss: We do not serve as storage, but in every possible scenario, we process your data securely. You must maintain and retain your original User Content. Totbot.io does not accept any responsibility for the loss, corruption, or deletion of any data you upload to the service.

5. Intellectual Property Rights

Our Intellectual Property: All intellectual property rights in the service are held by Totbot.io and/or its licensors (as appropriate). That means the site layout and navigation, source code, original graphics, tool user interfaces, and branding. You are licensed to use, for personal or commercial purposes, the Service for a period of time, on a limited, non-exclusive and non-transferable basis, depending on these Terms. No redistribution, sale, rent or copy of our proprietary software is allowed.

Your own IP: All original user content uploaded will remain yours. Also, Totbot.io disclaims all copyright and ownership of the generated content produced by our AI models. Responsibility for the use of the generated content will lie with you.

6. Hyperlinking to our Service

Standard linking to our website with no deceptive linking is permitted.

Links between any of our home page or specific tool pages may be made by government agencies, search engines, news providers, or educational or accredited businesses as long as the link:

(a) does not mislead or deceive;

(b) does not suggest that Totbot.io sponsors, endorses or approves of the content in any way; and

(c) fits within the context of the linking party’s site.

No Allowable Use: The logos and proprietary artwork of Totbot.io cannot be linked without a formal trademark/licensing agreement. In addition, you may not frame, embed, or otherwise alter the display of our Service on your website through the use of an iFrame or any similar technique without prior written authorization from Totbot.io. We reserve the right to request the removal of any link to our website at any time, particularly where we consider it inappropriate or damaging to our brand.

7. Third-Party Links and Services

Third-party websites, advertisers or services (like Google AdSense) included in the content of Our Service may be managed by other parties independent of Totbot.io, which are not directly liable for the accuracy and completeness or for the content published on their websites.

The content, privacy policies or practices applied to any third-party website are not controlled by us, and we have no responsibility for them. You recognise and agree that use of any such external content, goods or services by you will be an activity at your own risk for which Totbot.io accepts no responsibility whatsoever for any damage or loss which you might have as a result. 8. Disclaimer of Warranties ("AS IS")

You use the Service at your own risk. The service is offered “as is” and “as available”.

To the fullest extent allowed by the law, Totbot.io makes no warranties of any kind, express or implied, for merchantability, fitness for a particular purpose or non-infringement.

We make no warranty whatsoever that:

  • The Service will be ongoing, secure, or available at any given time or place.
  • Errors, bugs and defects in the algorithms and/or operation of this site will be fixed.
  • Inherent to the nature of the AI technology, the generated content will be factual, accurate, reliable and unbiased.
  • While we implement strong security measures to protect the Service, we cannot guarantee that the Service is entirely free from viruses or other harmful elements, and you are encouraged to use appropriate security software on your own devices.

9. Limitation of Liability

In all cases, to the maximum extent allowed by law, Totbot.io, its Directors, its employees, its partners, agents, suppliers or associates will not be responsible for any indirect, incidental, special, consequential or punitive damages.

It is understood that this encompasses loss of profits, data, use, goodwill or other intangible losses caused by:

(i) your access to or use of the Service, or your inability to access or use it;

(ii) any conduct or content of any other user of the Service;

(iii) any content obtained from or through the Service;

(iv) unauthorized access to, unauthorized use of, or alteration of your transmissions or content.

To the fullest extent, for you, the maximum liability for damages, losses and causes of action whatsoever of Totbot.io is limited to the sum you have actually paid Totbot.io in the last one (1) month or one hundred (100) USD.

10. Indemnification

You agree to defend, indemnify and hold Totbot.io and its licensee and licensors, as well as its employees, contractors, agents, officers and directors, harmless from and in connection with any and all claims, damages, obligations, losses, liabilities, costs or debts and expenses whatsoever (whether arising from this licence or otherwise) arising out of or resulting from:

  • Your access to and usage of the Service.
  • A breach of these Terms by you.
  • Submitting or generating content that infringes upon the intellectual property or other rights of any third party.

11. Termination

Your subscription could be cancelled or suspended at any time and without notice or liability based on our sole discretion and for any reason, including breaches of these terms.

A subscriber may cancel its subscription at any time by either stopping the use of the service or writing to the support staff to request that its data be deleted. None of the provisions contained in the Terms which may be implied as a consequence of their nature shall terminate, including ownership provisions, warranty disclaimers, indemnity and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of laws provisions.

In the event that there is any concern or dispute over the service, you shall first attempt to resolve the dispute informally by contacting Totbot.io support at support@totbot.io. Any formal legal proceedings arising from these Terms shall be brought exclusively in the state or federal courts of Delaware, and both parties hereby consent to the personal jurisdiction of such courts.

Natural consequences of failing to exercise any right or provision of these Terms will be deemed a waiver of that right or provision.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be removed or limited to the minimum extent necessary, and the remaining Terms will continue in full force and effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

14. Changes to These Terms

These Terms may be updated from time to time at our discretion. For minor changes, updates take effect immediately upon posting. For any material changes, we will provide at least 30 days' advance notice before the new terms take effect.

If we make changes to the terms, you will continue to be subject to these terms if you continue to use the Service after they take effect. Failure to accept the new terms means that you may no longer use the Service.
